TERMS, CONDITIONS, & GENERAL COURTESIES

Vacation Rental Agreement:

Please familiarize yourself with these customs to ensure your Ritz-Carlton vacation process is an effortless, informed & enjoyable experience. As the preferred Rental Agent of the St. Thomas and Aspen Highlands Owner Associations, Vintage Escapes is pleased to assist you with your vacation rental planning process.

RESIDENCE ASSIGNMENT - A Residential Lifestyle

"The Ritz-Carlton Club experience provides a level of service & attentiveness that is unique & special. You'll enjoy accommodations more spacious than traditional hotel rooms & suites. Your residence includes a separate living room, dining area, and fully equipped kitchen. In most residences, a separate half-bath near the living area is provided.

The Ritz-Carlton Destination Clubs are a collection of fractional ownership interests, and your Club residence reservation is confirmed to occupy a specific residence. Therefore, a change of residence upon arrival cannot be guaranteed. If you are staying at the Club for more than seven days , or arriving mid-week, it may be necessary to move from one residence to another. Rest assured, your Club Concierge and bell staff will notify you in advance if such a move is required.

Additionally, because many Members may be arriving and departing on the same day, requests for early arrivals or late departures cannot be accommodated. Club residences are significantly larger than traditional hotel accommodations and are appointed to exacting standards, therefore ample time is required to prepare for the next arriving Members and Guests." *

CHECK-IN and CHECK-OUT

Ritz-Carlton guests must vacate their residence no later than 11 AM, and check-in time is after 4:00 pm.

Changing facilities for early and late departures are provided in most locations.

RESERVATIONS

This Vacation Rental Agreement becomes a binding agreement when you send us your rental deposit via the on-line booking process or via our Vacation Planners. The terms and conditions concerning this Ritz-Carlton Club residence rental between you (the "Guest") and Vintage Escapes, LLC. Submitting payment constitutes your acceptance and agreement to these terms, conditions, limitations and restrictions as printed herein and forms a binding agreement. Please be sure to phone us at 877.388.9802 to discuss questions or for clarification on any items before you send us your rental deposit monies. Note: Specific unit will be assigned by the Ritz-Carlton upon check-in. Vintage Escapes, LLC, can not guarantee unit number. We reserve the right to substitute comparable or better accommodations without liability, should the residence be reserved, or inadvertently double-booked, or be deemed unavailable by us for any reason. If comparable accommodations are not available, Guest may receive a complete refund of all pro rated rent and Hotel Tax paid for the original villa.

PAYMENT AND CANCELLATION POLICIES

Half of your rent is required during the booking process to confirm your reservation. The balance due of rent, Government Hotel Tax, and damage deposit must be paid in full at least 60 days prior to your arrival. Vintage Escapes will accept only one (1) credit card from a rental party for rental payment. All cancellations and any request for changes to your reservation (this includes arrival and departure dates, and changes in the number of persons) must be made IN WRITING. For cancelations made more than 60 days prior to your arrival date, 80% percent of your total rent will be refunded to you and 20% percent of your total rent will be retained as full liquidated damages. If you cancel within 60 days of your arrival date, 100% percent of your total rent will be retained as full liquidated damages.

DAMAGE DEPOSITS

Your residence will be inspected upon your departure. Your damage deposit is fully refundable within 60 days of your departure. Reported breakage, damage, missing items, any additional cleaning for residence left abnormally dirty, long-distance calls charged to the residences telephone, and any other outstanding charges incurred before, during or after your stay, will result in deductions from your deposit. Guests agree to pay Vintage Escapes LLC, on behalf of the owner of your residence, replacement costs for all damages to personal property or to the real estate, which may occur as a result of your occupancy, excluding normal wear and tear. All Ritz-Carlton residences are fully furnished, including an ample supply of bed linens and towels for Guests use. Rearranging the furniture or removing any items from the residence is prohibited.

RENTAL RATES

Rates are based on two persons per bedroom and are subject to change. The number in your party should not exceed the maximum occupancy as stated for each residence. Private functions/parties are not allowed in residences without prior notice & approval. The published rental rates do not include GOVERNMENT HOTEL TAX of 8% (eight percent). A 7- night minimum stay is required during the HIGH SEASON.

LIABILITY

Vintage Escapes LLC, as owners Rental Agent, assumes no liability for property loss or damages, nor liability for injury, accidents, delay, or irregularity which may be occasioned either by reason of defect in any vehicle or the acts of any company or persons engaged in conveying passengers to or from their residence. Transportation (airlines, ferries, charter vessels, rental cars and taxis) is supplied by providers who operate independently of Vintage Escapes LLC. We assume no responsibility, therefore, for any loss, injury, or damage to person or property because of the acts of those providers. Guests acknowledge and are responsible for the residence during occupancy and must lock windows and doors securely at all times when not on the premises, and must exercise care in securing all personal property. We and the villa owners reserve the right to refuse service or rentals to anyone at their complete discretion.

NO PETS

Pets of any kind are NOT allowed (except for service pets) in or on the residence premises without specific written permission (granted prior to arrival). A pet or evidence of a pet found on premises will cause immediate eviction, and forfeiture of Guests entire rent and deposit.

COMPLAINTS AND MAINTENANCE

Every effort is taken to keep all residence and their inventories in good working order. In case of a maintenance problem, the Ritz-Carlton will strive to repair the problem as soon as possible after being notified. They reserve the right to be allowed several hours (up to 24 hours) to cure a reported problem. However, no refund or rate adjustment shall be made for unforeseen mechanical failures such as the supply of electricity, telephone service, internet service, water, pool filtration systems, hot tubs, air conditioning, television or cable service, appliances, etc. It is the obligation of the Guest to report any problems or damage to their villa IMMEDIATELY to the Ritz-Carlton and/or Vintage Escapes.

INTEREST-BEARING ACCOUNT

Guest understands that all rental monies shall be deposited in an interest-bearing escrow account until the rental begins, with any and all interest accrued to be retained by Vintage Escapes LLC.

PRINTING ERRORS

In any dispute arising out of this Vacation Rental Agreement, the agreement shall be governed by and construed in accordance with the laws of the State of South Carolina. The prevailing party shall recover its costs, expenses and reasonable attorneys' fees.
